Privacy Policy
What we collect, why, who we share it with, and what other people on Encore can see about you.
1.Introduction#
This policy explains how Encore Music, Inc. (“Encore”, “we”, “us”) handles personal information when you use Encore Music. It covers listeners, artists, and anyone else who visits. Our Terms of Service govern the rest of your use of the Service.
Encore is the controller of the personal information described here. Where we act as a processor on an artist’s behalf, we say so.
2.Information we collect#
Information you give us
- Account details — your email address, your name or the name you choose to display, your handle, and your password or the third-party sign-in you use.
- Profile content — anything you add to a public profile, such as a biography, avatar, links, and images.
- Location — the country and city you choose to add to your profile. Both are optional.
- Content you upload — audio, artwork, video, track and release details, and anything else you publish or keep as a draft.
- Messages — what you send us for support, and feedback you choose to submit.
When you buy something
- Order details — what you bought, from whom, the amount, the date, and the email address the receipt goes to.
- Billing information — the billing name and address you enter, which we use to process the payment and to determine any tax we must collect.
- The country that issued your card — we record this against the order. Cards issued outside the United States cost more to process, and because artists bear processing costs we keep a record of why a given sale cost what it did. We do not record your card number, and this is not shown to the artist.
- Your display currency — if you choose to see approximate prices in another currency, we store that choice, and we store it on your account if you are signed in so it follows you between devices.
When you sell
- Payout status — whether your payout account is set up and able to receive money, the country it settles in, its currency, and what our payment processor says is still outstanding.
- Earnings records — your sales, fees, payouts, and any amounts held or reversed.
Collected automatically
- Technical information received by our hosting provider in order to serve your request and keep the Service secure — your IP address, browser and device type, the pages requested, timestamps, and error diagnostics.
- An approximate country, derived from your IP address by our hosting provider. We use it for one thing: offering you your local currency once, so prices can show an approximate figure beside the dollar price. It is not stored against your account, and if you decline we record only that you were asked.
- A delivery record for each download — which file you downloaded, in which format, when, and the IP address and browser or app the download was requested from. A digital purchase has no tracking number and no signature, so this record is how we can show that a file you paid for was delivered to you. We rely on it to resolve disputed charges, to answer questions about a purchase, and to detect misuse of download links. We keep the IP address and the browser or app for two years from the date of the download and then erase them; the rest of the record, which is not personal to you, is retained with your order. Our lawful basis is our legitimate interest in proving delivery and defending payment disputes.
What we never receive
Encore never receives your full card number, and never receives the identity information our payment processor collects from artists — government identifiers such as a Social Security or company registration number, date of birth, identity documents, or bank account details. When an artist completes payout setup, that information travels from their browser to Stripe directly and does not pass through Encore’s systems. This is deliberate, and it is why payout setup happens inside Stripe’s own component rather than in a form we built.
4.How we use your information#
- To operate the Service — your account, your library, uploads, and playback.
- To take payment, deliver purchases, issue receipts, and pay artists and their collaborators.
- To give artists aggregate statistics about their audience, such as where their listeners are.
- To provide support and respond to you.
- To send service messages you cannot opt out of while you hold an account, such as receipts, payout notifications, and security alerts.
- To send marketing email where you have asked for it. You can unsubscribe at any time, and doing so does not stop service messages.
- To keep the Service safe — detecting fraud, payment abuse, and misuse, and enforcing our terms.
- To meet legal obligations, including tax, accounting, and unclaimed-property requirements.
Legal bases, if you are in the UK or EEA
- Contract — operating your account, taking payment, delivering purchases, and paying artists.
- Legitimate interests — securing the Service, preventing fraud, giving artists aggregate statistics about their audience, and improving what we build, where those interests are not overridden by your rights.
- Consent — marketing email. You may withdraw it at any time.
- Legal obligation — tax, accounting, and responding to lawful requests.
6.What other people can see about you#
Encore deliberately limits what one person can learn about another, and enforces it on our servers rather than by hiding fields in the interface.
- Your public profile — your display name, handle, avatar, and anything you publish — is visible to anyone.
- Following someone does not reveal your email address to them. Followers are shown to an artist by public profile only.
- When you buy from an artist, they see an abbreviated name and a masked email address — enough to recognise a supporter and to understand their audience, not enough to contact you directly outside Encore. They also see what you bought and when.
- Your billing address, your card details, and the country that issued your card are never shown to an artist.
- Your location is never shown to an artist with your name. If you are a listener, your country and city only count toward totals. An artist’s own location is part of their public profile.
Artists receive aggregate statistics about their audience. These never identify individuals.
7.How long we keep it#
We keep your account information while your account is open. When you close it, we delete or anonymise what we no longer need.
Some records outlive the account, because they have to. Orders, earnings, payouts, and tax records are financial and legal records for both sides of a transaction: an artist is entitled to their sales history and we are required to keep accounting records, so closing your account does not erase a purchase that happened. Where money is held for someone we cannot currently pay, we keep what we need to pay them or to meet unclaimed-property obligations, which can run for several years.
Download delivery records keep the IP address and the browser or app used for two years from the date of the download, after which we erase both. We chose that period because it comfortably outlasts the window in which a card payment can still be disputed, which is the reason we hold those details at all. The remainder of the record — what you downloaded, in which format, and when — is kept with your order, because it is part of the history of a purchase and is not personal to you once those two details are gone.
Waitlist records and marketing consent are kept until you unsubscribe or ask us to delete them.
8.Security#
We use encryption in transit, restrict access to personal information to those who need it, and rely on established providers for the most sensitive processing — which is why card and identity data go to our payment processor rather than to us. No system is perfectly secure, and we cannot guarantee absolute security, but we will tell you and any regulator we must if a breach affects your information.
9.International transfers#
Encore is based in the United States and our providers may process information in the United States and elsewhere. Where we transfer personal information out of the UK or EEA, we rely on appropriate safeguards, including the European Commission’s standard contractual clauses and the UK addendum.
10.Your rights#
Subject to local law, you may ask us to give you a copy of your personal information, correct it, delete it, restrict or object to how we use it, or provide it in a portable form. You may withdraw consent to marketing at any time.
You can update much of this yourself in your settings. For anything else, write to support@encoremusic.studio. We will respond within the time the applicable law allows, and we will not treat you differently for exercising a right.
Deletion has limits we would rather state than surprise you with. We cannot delete records we are required to keep, and we cannot remove a completed transaction from the other party’s records — an artist keeps their sales history, and a buyer keeps their receipt.
If you are in the UK or EEA you may complain to your local supervisory authority. If you are in California, you may exercise the rights described above, which we provide to everyone; we do not sell or share personal information as those terms are defined there.
11.Children#
Encore is not for children under 16, and we do not knowingly collect their personal information. If you believe a child has given us information, write to support@encoremusic.studio and we will delete it.
12.Changes to this policy#
We may update this policy. We will revise the “Last updated” date above, and where a change materially affects how we use your information we will give you notice before it takes effect.
